Removal Orders, in all cases, require that you leave Canada. If you fail to appear for an interview on the removal date, CBSA will issue a Canada-wide arrest warrant.
Types of Removal orders:
- Departure Order – A departure order requires that you must leave Canada within 30 days of the order coming into force. If you do not leave Canada within the 30 days and/or do not inform CBSA of departure from the country, the departure order will become a deportation order.
- Exclusion Order – An exclusion order requires you to leave Canada, confirming departure with the CBSA on exit from the country. Depending upon the reasons for which the exclusion order was issued, exclusion orders include a time period for which a foreign national is barred from entering Canada. With an Exclusion Order, you cannot return to Canada for one year.
- If you wish to return before 12 months have passed, you must apply for an ARC (Authorization to Return to Canada) .
- If an exclusion order has been issued for misrepresentation, you cannot return to Canada for five (5) years.
- If the CBSA paid for your removal from Canada, you must repay that cost.
- If 12 months have passed since you left Canada and you have a Certificate of Departure (IMM 0056B) showing the date you left Canada you do not need an ARC (Authorization to Return to Canada).
- Deportation Order – With a Deportation Order, you are permanently barred from entering Canada. You cannot return unless you apply for an ARC (Authorization to Return to Canada).You must repay the cost if Canada Border Services Agency (CBSA) paid for your removal from Canada, before you are eligible to return to Canada.
